On necessary amendments and additions to the Law of the Russian Federation from March 11th, 1992 N 2487-1 "On private detective and security activity in the Russian Federation"

On December 3rd, 2015 in the meeting room of the MIA of Russia there was held a Meeting of the Coordination Council on interaction with private security organizations and private detectives at the Interior Ministry.

The Meeting was attended by members of the CC at the Ministry of internal Affairs of Russia (representatives of the federal bodies of the state power, the ALPW, the Main Department of Public Order Protection, the Main Department of private security services, the Main Department of Transportation, the Department of logistical and medical support of the MIA of Russia,  representatives of the Public Chamber of the Russian Federation, the all-Russian public organization “Business Russia”, the Association “CC RSDS”, the self-regulatory organization “School without danger”, the Voluntary Society for Assistance to Army, Air Force and Navy of Russia, other representatives of the NSS and experts.

The event was held via videoconference involving all heads of the interested divisions of territorial bodies of the MIA of Russia at the regional level, members of the CC at the Ministry of Internal Affairs of Russia from the regions.

The leader of the Meeting, Deputy Chairman of the Coordination Council, Chief of the ALPW in the MIA of Russia, General-major of the police, Leonid Vladimirovich Vedenov addressed the introductory and concluding remarks to the audience, who, in particular, stressed that it is being elaborated the document about necessary amendments and additions to the Law of the Russian Federation from March 11th, 1992 N 2487-1 “On private detective and security activity in the Russian Federation”. The draft of the Federal law presumes, in particular, to raise the efficiency of cooperation of the Ministry of Internal Affairs of Russia with private security organizations and private detectives at a new level. Vedenov noted that the draft law is to strengthen the role of private security organizations in assisting law enforcement agencies to ensure law and order, including the places of providing security services and related areas, and private detectives - in preventing and solving crimes, prevention and suppression of administrative offenses.

 

The right of private security organizations in providing assistance in law enforcement will be changed into responsibility. Also, the bill provides for the establishment of additional requirements to the private security company providing security services for the state and municipal needs. It is expected that these requirements will include experience of execution of the contract (agreement) for the protection of the state and municipal facilities for the last 3 years, absence of serious violations of licensing requirements during the year preceding the conclusion of the contract (agreement), presence not less than 100 employees in the staff.

In addition, in connection with frequent cases of violations of the rights and freedoms of citizens by persons, who take the position of administrators, supervisors, which are brought by commercial network to the control (surveillance) of preservation of the property located in the territory of the trading object, the bill introduces a new category of employees of PSOs of the “controller-observer”, whose functional responsibilities related to the implementation of visual control (surveillance), including the use of technical means of protection, over the people, which are at the subject of protection, and adjacent territory, with the aim of preservation of the property. The proposed innovation will allow to increase the responsibility of legal persons for the actions of these employees, as well as to organize this sphere of activity.

Vedenov noted that the Bill has been prepared, taking into account the provisions of the Federal law from December, 31st, 2014  No. 534-FL “On amending the Russian Federation Law “On private detective and security activity in the Russian Federation”, which has introduced a new kind of security services: protection of objects and (or) property, and ensuring inside the object and access control at the facilities, which are mandatory to comply with requirements of anti-terrorist protection. Besides, the Federal law allows to establish special requirements to private security companies, providing security services in these facilities.

During the Meeting there were discussed the main trends of development at the present stage of the institution of private security activity in the Russian Federation and priority directions of its improvement in the interests of law and order and national security, presented current problems of quality of provision of security services and priority measures for its growth in terms of expanding the scope of the PSO. Participants also discussed the degree of the PSO staff, the need for minimum prices and their adjustment in conjunction with the Chamber of Commerce of the Russian Federation, as well as legal aspects to assist the Ministry of Internal Affairs by the private security organizations.
